The lawyers who brought the case against Prop. 8 believe yesterday's Supreme Court decision in the Christian Legal Society case destroyed what's left of the other side's argument. And, they wrote that to Judge Walker. Via Karen Ocamb:
"Attorney Theodore J. Boutrous Jr., counsel to the plaintiffs in the Perry v. Schwarzenegger challenge to the constitutionality of Prop 8, sent a letter to District Court Judge Vaughn Walker today taking note of Tuesday’s ruling by the U.S. Supreme Court that “definitively held that sexual orientation is not merely behavioral, but rather, that gay and lesbian individuals are an identifiable class.” Boutrous says the case not only adds merit to the plaintiffs’ argument but says it leaves little for the Prop 8 proponents to stand on."
Read the full letter. It is entirely proper for Judge Walker to consider today's decision in writing his ruling and opinion.

Not that there was much to stand on to begin with. Their case was pathetic, from what I have seen.
